Do I have to give up my house or my car?

If you are making payments on a house and/or a car, as long as you are current on your payments, you will not have to surrender those assets.


Will I have to give up any of my other property?

The Bankruptcy Code is very generous in its exemptions, which almost always allow an individual to exempt, or protect, all of their assets


Are medical bills wiped out in a bankruptcy?



How has bankruptcy changed with the new law?

The biggest change is the means test which Congress put in the new law. Basically, if you are above the median income for your family size by more than $167 a month, you will be required to file a Chapter 13 and pay back at least $6000 to your creditors over five years.


Do I have to go to credit counseling?

Yes, you will have to go to a credit counseling session both before and after you file your bankruptcy. However, the counseling session is inexpensive and can be done either over the phone or on the Internet.


Can anybody file a bankruptcy?

Yes, absolutely! The only question is whether you will file a Chapter 7 or Chapter 13.


What do I need to bring to my office appointment?

You will need to bring the last six months’ pay stubs for each person filing, as well as a transcript of the most recent tax return you have filed.


Can I refer my creditors to you?

Once you have paid the initial, non-refundable retainer of $100, you can refer all of your creditors to our office. We take the calls, so you don’t have to!


When will my bankruptcy be filed?

Once you have turned in your finished questionnaire and paid your fees in full, your information will be thoroughly reviewed with an attorney at which point your case will be filed with the Bankruptcy Court.
